Canada Revenue Agency after B.C. Hells Angels assets

Nov 22, 2012. The Canada Revenue Agency has obtained a court order under the Income Tax Act against one of the owners of the Hells Angels Kelowna clubhouse for more than $319,000.

The Federal Court of Canada signed off Sept. 20, 2012 on the CRA claim against Hans Frederick Kurth, an owner of the bikers’ clubhouse at 837 Ellis Street in Kelowna.

The taxman has now put a lien on Kurth’s half-interest in the property, which is also the subject of a civil forfeiture suit filed by the B.C. government.
Defendants include Jean Violette, Ronald Cameron, John Bryce, Mitchell Riley, Michael Mitchell, Stanley Gillis, Kelly Schofield, Michael Christiansen, John Punko, Kim Harmer, Hans Kurth, Joseph Skreptak, Lester Jones, David Giles, Richard Goldammer, Robert Thomas, Norman Cocks, Michal Zikmund, Brian Oldham, Greg Holomay and Damiano Di Popolo.

Twenty-one Hells Angels and associates are named in the civil forfeiture suit, including Kurth and Kelowna Hells Angels vice-president David Giles. Giles is also battling the CRA in the Tax Court of Canada, The Vancouver Sun has learned.

In fact, the taxman claims Giles lied about his income between 2004 and 2008, failing to declare more than $1.1 million in “earnings from a drug trafficking business.”

The court documents say Giles reported earnings of just $43,101 in 2004, $15,000 in 2005, $33,508 in 2006, $33,003 in 2007 and $13,503 in 2008.

“The appellant’s reported income for 2004, 2005, 2006, 2007 and 2008 was insufficient to support his personal expenditures of $185,947, $271,101, $78,961, $205,755 and $311,401 in those years,” the government claimed in a response to Giles’ appeal. “During the relevant taxation years, the appellant acquired high value assets, including real property, a boat and several motor vehicles,” the documents said.
He said he borrowed a lot of money between 2004 and 2007, which he didn’t repay during the period the CRA was reviewing.

Among the loans listed are two from East End Hells Angels president John Bryce totaling $125,000 in 2005 and 2007.
