The decision of Brampton judge Khatira (Kathy) J. Jalali not to hand down the statutory required four-month jail sentence to a man who had been convicted of his fifth impaired driving offence is “an affront to the administration of justice,” a superior court judge wrote in her decision overturning the ruling. There was “no legal basis’ for the lower court judge to impose a conditional sentence to Joseph LeClaire, who had pleaded guilty to his fifth impaired driving offence.
“What would you do if I sentenced the gentleman to four months conditional anyways?” Jalali asked Crown attorney Brennan Jackson.
“That is not permitted by statute,” Jackson responded.
“I know, but what if I do,” the judge asked.
Justice Khatira (Kathy) J. Jalali was called to the bar in 2002. Jalali is predominantly an Iranian name. She was an associate with Mackay and Mackay until 2009 when she established her own practice specializing in criminal defence. Since 2002, Jalali served as per diem duty counsel in Brampton, Halton Region and Dufferin County. She was appointed Ontario Court of Justice, on October 10, 2018. Khatira Jalal-Jalali held the position of Judge in 2024 and received an annual salary of $359,134.62
This ridiculous clown judge heard LeClaire was driving the wrong way on Winston Churchill Boulevard in Mississauga on the night of Nov. 27, 2020. LeClaire was driving a Toyota RAV4 with only the rims on the front passenger side of the vehicle. Sparks were sent from the damaged wheel rim as he swerved into the opposite lanes of traffic.
This would be the second piss poor terrible judge we have run across in Brampton in weeks. Here. This space has said it a few times. The rejection rate for complaints to the Canadian Judicial Council (CJC) is 97% and those making the decisions are demonstrably full-on idiots. This is what Canadians end up with … ‘judges’ that refuse to follow the fukkin law.
